These Terms and Conditions ("Terms") govern your use of the Hoosier Storm Shelters LLC ("Hoosier Storm Shelters," "we," "our," or "us") website and services. By accessing our website or engaging our services, you agree to be bound by these Terms.
Our Services
Hoosier Storm Shelters LLC provides storm shelter sales, delivery, and professional installation services throughout Indiana. Our services include:
- Free site visits and consultations
- Custom storm shelter solutions (Slant Top, Walk-In, and Top-Hatch models)
- Professional excavation and installation
- 10-year construction warranty
- 3-year leak protection warranty
Quotes and Pricing
All quotes are provided free of charge and require a site visit to ensure accurate pricing. Pricing factors include:
- Shelter type and specifications
- Installation location and accessibility
- Excavation requirements
- Site-specific conditions
Quotes are valid for 30 days from the date of issue. Prices may vary based on material costs and site conditions. All quotes include the shelter, delivery, and standard installation. Additional costs may apply for non-standard installations or difficult site access.
Payment Terms
We operate on a no-deposit-required basis. Payment terms include:
- No deposit is required to schedule installation
- Payment is due upon completion of installation
- We accept cash, check, and major credit cards
- A signed contract is required before work begins
Installation and Site Requirements
Customer Responsibilities:
- Provide accurate information about the installation site
- Ensure clear access to the installation location
- Obtain any necessary permits or homeowner association approvals
- Mark underground utilities (call 811 before we dig)
- Be present or have an authorized representative on-site during installation
Our Responsibilities:
- Complete installation in one day under normal conditions
- Perform all necessary excavation work
- Ensure proper shelter placement and functionality
- Clean up the work site upon completion
- Provide warranty documentation
Warranties
10-Year Construction Warranty: We warrant that your storm shelter will be free from defects in materials and workmanship for ten (10) years from the date of installation.
3-Year Leak Protection: We warrant that your storm shelter will remain watertight and free from leaks for three (3) years from the date of installation.
Warranty Limitations:
- Warranty does not cover damage from improper use, modifications, or negligence
- Warranty does not cover damage from natural disasters, acts of God, or unusual circumstances
- Customer must maintain the shelter according to provided guidelines
- Warranty is non-transferable and applies only to the original purchaser
Cancellation and Rescheduling
By Customer: You may cancel or reschedule your installation appointment with at least 48 hours' notice without penalty. Cancellations with less than 48 hours' notice may incur a rescheduling fee.
By Hoosier Storm Shelters: We reserve the right to cancel or reschedule installations due to severe weather, equipment failure, or other circumstances beyond our control. We will make every effort to notify you as soon as possible and reschedule at your convenience.
Limitation of Liability
To the fullest extent permitted by law:
- Our total liability for any claim arising from our services shall not exceed the total amount paid for the storm shelter and installation
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not responsible for underground utilities not properly marked by the customer or utility companies
- Storm shelters are designed to provide protection during severe weather, but we cannot guarantee absolute safety in all circumstances
Insurance
Hoosier Storm Shelters LLC maintains general liability insurance to protect both our business and our customers. We are fully insured and licensed to operate in Indiana.
Dispute Resolution
In the event of any dispute arising from these Terms or our services, both parties agree to:
- First attempt to resolve the dispute through good-faith negotiation
- If negotiation fails, submit the dispute to mediation in Indiana
- Any legal proceedings shall be governed by the laws of the State of Indiana and conducted in the appropriate courts of Indiana
Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Hoosier Storm Shelters LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.
Acceptable Use of Website
You agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Transmit viruses, malware, or other harmful code
- Interfere with other users' access to our website
- Collect or harvest personal information from our website
Changes to Terms
